The USTR Extends Some List 1 and List 2 Items, But Most Expire on October 2

The Office of the United States Trade Representative (USTR) has extended the exclusions on a limited number of products from China Sec 301 List 1 and List 2 duties.

The exclusions on hundreds of other products on those lists will expire on October 2, 2020.

Exclusions for 9 products on List 1 were extended until December 31, 2020.

USTR Extends Some Tariff Exclusions for List 1 and 2 Products But Many Expire on September 20here.

List 2 contained 17 parts where the exclusions were extended to December 31, 2020, the List 2 Notice can be found here.

The USTR did not extend over 300 exclusions previously granted to products subject to List 1 or 2 tariffs.

This means that the exclusions for these products will expire on September 20, 2020, so effective September 21st, these products will carry the additional Chinese 25% duties that were originally assessed.

USTR Seeks Public Comments for Extending List 1 Product Exclusions

The Office of the United States Trade Representative is initiating a review of certain List 1 products HTS provisions for possible 12 month extensions of exclusions from the China Section 301 tariffs.

Comments may be submitted between August 1 and August 30,2020.

All submission requests must be sent electronically via the USTR Comment Portal, the docket number is USTR-2020-0030.

USTR Grants Exclusion Extensions to 12 Products from China Section 301 List 1 But Does Not Extend Exclusions On Almost 100 Other Products

The Office of the U.S. Trade Representative (USTR) has announced that only 12 exclusions from the sixth round of Section 301 tariff exclusions on List 1 goods (found here) would be receiving extensions until December 31, 2020, however they did not grant extensions to many of the other products and as a consequence, Section 301 25% duties will again have to be paid on those items effective July 9, 2020.

The Office of the U.S. Trade Representative has extended until December 31, 2020 the exclusion of the following products from the Section 301 additional 25 percent tariff on imports of List 1 goods from China.

8425.39.0100 – Ratchet winches designed for use with textile fabric strapping (described in statistical reporting number
8431.20.0000 – Counterweight castings of iron or steel designed for use on fork lift and other work trucks
8431.20.0000 – Tines, carriages, and other goods handling apparatus and parts designed for use on fork lift and other works trucks

On Friday, March 13, the Office of the U.S. Trade Representative (USTR) announced that several exclusions from the second round of Section 301 tariff exclusions on List 1 goods will be granted extensions. A copy of the USTR notice can be found here.

Two complete HTS numbers that had previously been granted exclusions until March 25, 2020 have been extended until March 25, 2021. These HTS numbers are 8412.21.0045, and 8607.21.1000.

Additionally, nine other HTS codes that contained product specific exclusions have also been extended until March 25, 2020. The specific product descriptions are outlined below:

1. Breast pumps, whether or not with accessories or batteries (HTS 8413.81.0040)
2. Machinery for filtering water, submersible, powered by batteries, manually operated, such machinery designed for use in pools, basins, aquariums, spas or
similar contained bodies of water (HTS 8421.21.0000)
3. Hand-held ultraviolet water purifiers, powered by batteries (HTS 8421.21.0000)
4. Filters designed to remove sulfites from wine (HTS 8421.22.0000)
5. Filter housings, covers, or couplings, the foregoing of steel and comprising parts of machinery or apparatus for filtering liquids (HTS 8421.99.0040)
6. Vulcanized rubber tracks, each incorporating cords and cleats of steel, designed for use on construction equipment (HTS 8431.49.9095)
7. Automated data processing storage units (other than magnetic disk drive units), not assembled in cabinets for placing on a table or similar place, not presented with any other unit of a system (HTS 8471.70.6000)
8. Electric motors, AC, permanent split capacitor type, each in a housing with outside diameter of 84 mm or less, with output of 6 W or more but not exceeding 16 W (HTS 8501.10.4020)
9. Inoculator sets of plastics, each consisting of a plate with multiple wells, a display tray, and a lid; when assembled, the set measuring 105 mm or more but not exceeding 108 mm in width, 138 mm or more but not exceeding 140 mm in depth, and 6.5 mm or less in thickness (HTS 9027.90.5650)

On Monday, February 10th, the USTR announced a limited group of product exclusions for Section 301 List 1 Tariffs.

A copy of the February 10 notice can be found here. These most recent exclusions apply to four specific product descriptions as listed below:

• Centrifugal pumps, submersible, designed for use in artificial lift systems for extracting oil and gas (described in statistical reporting number 8413.70.2004)
• Pistons and housings for hydraulic fluid power pumps of the type used in power lawn mowers (described in statistical reporting number 8413.91.9050 prior to January 1, 2019; described in statistical reporting number 8413.91.9060 effective January 1, 2019)
• Furnace roll end-shafts of steel (described in statistical reporting number 8417.90.0000)
• Multi-phase AC motors of an output of at least 5.8 kW but not exceeding 14.92 kW, each assembled with planetary gears and a gearbox (described in statistical reporting number 8501.52.4000)

This latest round of exclusions will retroactively apply to all products meeting the specified criteria effective July 6, 2018 and will expire on October 1, 2020. As usual, any importer who has an eligible product is able to claim an exemption under the new exclusions, regardless of whether the importer filed an exclusion request.

The Office of the U.S. Trade Representative (USTR) has announced it is extending exclusions of the following List 1 products from the Section 301 additional 25 percent tariff on imports from China. The product exclusion extensions announced in this notice will apply as of December 28, 2019 and will extend the exclusions for one year.

• HTSUS 8418.69.0120 (drinking water coolers, self-contained)

• HTSUS 8525.60.1010 (CB transceivers)

• roller machines with dies for embossing paper, manually powered (described in HTSUS 8420.10.9080)

• angle cock handle assemblies, of iron and steel, each measuring 11.43 cm by 21.59 cm by 5.08 cm and weighing 0.748 kg (described in HTSUS 8481.90.9040)

• radiation therapy systems, each encased by steel-based structural shell with gantry cover comprising three pairs of plastics-based panels (described in HTSUS 9022.14.0000)

• thermostats designed for air conditioning or heating systems, not designed to connect to the Internet, the foregoing designed for wall mounting (described in HTSUS 9032.10.0030)

It is important to note that the USTR declined to extend the other 33 exclusions granted in December 2018, which covered such items as spark-ignition engines for marine propulsion, stainless steel stretchers, plastic salad spinners, water filtration apparatus, winches, elevators, belt conveyors, work stands, and stainless steel guards, scrapers, and suction boxes. These exclusions will expire as of Dec. 28, at which point the 25 percent additional tariff will again be imposed on covered goods.

UPDATE October 31, 2019

The USTR Will Open a Public Comment Period on Extending the First Round of Section 301 Exclusions

The United States Trade Representative (USTR) has announced that on November 1, 2019 they will open a process to consider 12 month extensions of the Section 301 List 1 exclusions that were issued on December 28, 2018.

These exclusions are set to expire on December 28, 2019, and the USTR is now considering a possible extension of these exclusions and will evaluate each on a case-by-case basis.

Comments may be submitted between November 1 and November 30, 2019.

The official notice will be issued later this week but a copy can already be found here.

According to the USTR, the focus of the evaluation will be whether, despite the first imposition of these additional duties in July 2018, the particular product remains available only from China.

In addressing this factor, commenters should address specifically:

Whether the particular product and/or a comparable product is available from sources in the United States and/or in third countries.
Any changes in the global supply chain since July 2018 with respect to the particular product, or any other relevant industry developments.
The efforts, if any, the importers or U.S. purchasers have undertaken since July 2018 to source the product from the United States or third countries.

In addition, USTR will continue to consider whether the imposition of additional duties on the products covered by the exclusion will result in severe economic harm to the commenter or other U.S. interests.

UPDATE July 9, 2019

The USTR has announced that more than 100 additional goods have been excluded from the additional 25 percent duty previously imposed on some $34 billion worth of imports from China (List 1 goods).

These exclusions cover 110 specially prepared product descriptions listed in the enclosed notice that were derived from 362 separate exclusion requests. The exclusions will be retroactive to July 6, 2018, and remain in place until July 9, 2020.

The Office of the United States Trade Representative (USTR) has just announced a third group of 21 specific products to be excluded from the additional 25% tariff rates imposed on List 1 goods. The exclusions are retroactive to July 6, 2018 and will remain in place until April 18, 2020. Various products are covered by this latest exclusion and were based on 348 exclusion requests.

UPDATE: March 28, 2019

As mentioned below, Federal Register Notice dated March 25, 2019 has now been issued which lists the 3 HTS numbers that are totally exempt from additional duties, as well as those products that may qualify for the partial exemption of an additional 30 HTS numbers.

Please note that these partial exemptions are product specific so even if you import items under any of these 30 HTS numbers, your product still may not qualify for the exemption. To review the specific product requirements, you can access the Federal Register Notice below.

The Office of the U.S. Trade Representative has just announced a second round of products that will be either completely or partially excluded from the additional 25 percent duty imposed on some $34 billion worth of imports from China (List 1 goods).

These exclusions will be retroactive to July 6, 2018, and will remain in place for one year after the date of publication of the exclusion determination in the Federal Register, which we expect to be published shortly.

In total, 33 additional tariffs will be excluded either completely or partially.

The following three HTS numbers are totally excluded: 8414.21.0045, 8430.31.0040, 8607.21.1000.

The following 30 additional HTS numbers will be granted a partial exclusion:

8413.70.2004, 8413.81.0040, 8413.91.9095, 8413.91.9080, 8414.90.4165, 8421.19.0000, 8421.21.0000, 8421.22.0000, 8421.99.0040, 8428.32.0000, 8431.49.9095, 8439.91.9000, 8471.70.6000, 8479.10.0060, 8481.30.9000, 8501.10.4020, 8501.31.5000, 8504.32.0000, 8515.11.0000, 8538.90.6000, 8539.90.0000, 9013.80.7000, 9014.80.2000, 9018.90.7580, 9027.90.5650, 9031.80.8085.

These exclusions can be claimed using new HTSUS subheading 9903.88.06, and they are available for any product that meets the specific product description, regardless of whether the importer filed an exclusion request.

USTR notes that the scope of each exclusion is governed by the scope of the 10-digit headings and the specific product descriptions and not by the product descriptions set out in any particular request for exclusion.
